In most cases making an application to court should be a last resort, it is costly, time consuming and can be unpredictable. Sometimes the intervention of the court is necessary to secure your position, enforce an existing order or protect your child but we will always strive to resolve matters by agreement where possible.
We take a non-adversarial approach, we will ‘fight’ hard for our clients when necessary but we always discuss possible compromises that may be acceptable to you as soon as we have sufficient information to do so. We fully endorse and adhere to the Resolution Code of Conduct and the Family Law Protocol which places an obligation on family lawyers to work in a non-confrontational and constructive way to preserve people’s dignity and to encourage agreements.
Your situation is unique and you can be assured we treat it as such. Clients often say to us, ‘I expect you will have heard this all before?’ or ‘I’m sure it’s the same for all your clients’. We don’t agree; no two cases are ever the same. We work hard, both for you, and with you, to identify what matters most to you and your family, what the relevant issues and greatest concerns are and how best to secure an appropriate and acceptable resolution.
We know the costs of legal representation are a concern. We will offer a fixed fee for work if possible so you know the exact costs at the outset. If we are unable to offer a fixed fee you will always be provided with a costs estimate in advance of any work being undertaken and we are happy to specify a costs limit beyond which we will not go without your further authorisation. You can instruct us as little or as much as you wish; for intermittent ad hoc advice whilst you attend mediation or negotiate directly with the other party, just for a court hearing, or for a ‘full service’ dealing with all aspects of your matter on your behalf so you do not need to have any communication with the other party or their lawyers about the issues.
